Purpose

These general conditions (henceforth 'General Conditions') regulate the use of all the services for the website www.iasist.com (henceforth 'website') owned by IASIST S.A., Spanish company based at Rambla de Catalunya 2-4, 6º, 08007-Barcelona (henceforth "IASIST"), telephone + 34 93 3014061, with CIF A59769463 e registered in the Mercantile register in Barcelona, volume 21089, page 1, sheet B-16419, 1st inscription.

Simply by accessing and using the Website, the user demonstrates their full acceptance of the General Conditions, with no reservations, so the user is recommended to read them carefully.

The General Conditions can be modified by IASIST at any time and they can be complemented by recommendations and/or conditions and specific instructions that users will receive information on from IASIST when using a specific service and that they will also have to comply with.

Purpose

The aim of this Website is to offer free information on IASIST and its products and services. The information provided on the Website can change over time and it is only offered as shown, with no type of guarantee. If you contract a product or service from IASIST, the terms related to this product or service will be regulated in your contract with IASIST, not by the Website's General Conditions.

Access conditions

Users who access the website are expressly authorised to view all the information, the printing and partial download of its content only and exclusively if the following conditions concur:

  1. That this is done when the elements copied are only intended for the users' personal and private use. Therefore its use for commercial purposes or for distribution, reproduction, public communication (including the right to make it available), transformation, collection, decompilation and the exploitation, in any other way, of the contents (images, texts, design, indices, forms, etc.) appearing on the Website is expressly prohibited without prior written authorisation from IASIST. It is also prohibited for these contents to be surrendered or transmitted to third parties or to be installed on any server which is directly or indirectly connected to a local network and the internet, so that a group of third parties might have access to this information.

    All use or exploitation which differs from the above will require prior written authorisation from IASIST.

  2. That none of the related contents in the Website are modified at all.

IASIST reserves the right, whenever necessary and without needing to give prior warning, to make all the modifications and updates to the information contained on the iasist.com website - in any of its language versions - for its configuration and presentation and for the General Conditions.

IASIST does not guarantee that interruptions or errors will not exist when accessing the Website or its different contents. Nor does it guarantee that its content is always, and in all cases, updated, although it will make the greatest possible effort to avoid this situation and to correct or update this content as quickly as possible. IASIST does not assume any type of responsibility for any of the information contained in other websites which might be reached through links from iasist.com.

IASIST does not assume any responsibility derived from the concession or contents of third party links which are referred to in the Website, or guarantee the absence of viruses or other elements in which disturbances can occur in the user's computer system (hardware and software), documents or files, excluding any responsibility for damage of any type caused to the user for this reason.

Both access to Website and the use which can be made of the information it contains is the exclusive responsibility of the person involved in this process. IASIST will not answer to any consequence, damage or harm which could be derived from this access or use of the information or contents. IASIST is not responsible for possible security errors which might occur, or possible damage which might be caused to the user's computer system (hardware and software), as well as the files or documents stored in it, as a consequence of the presence of a virus in the user's computer used to connect to the Website services and contents, poor functioning of the browser or the use of non-updated versions of it.

Any technical, logical or technological resources by virtue of which a third party might benefit, directly or indirectly, with or without profit, from the contents of the Website are prohibited. Specifically, unless IASIST has authorised this previously and expressly, no link, hyperlink, framing or similar link can be inserted directing users to the Website.

Industrial and intellectual property rights

IASIST is the owner of the industrial and intellectual property rights referring to its products and services. IASIST is also the owner of the industrial and intellectual property rights over the contents of the Website (images, texts, design, indices, forms, etc.), unless specified to the contrary. Specifically, IASIST owns the "IASIST" registered brand. Regarding the quotes on products and services from third parties, IASIST recognises the corresponding industrial and intellectual property rights in favour of their owners, where their mere mention or appearance on the website does not imply the existence of rights or any responsibility for IASIST for them, nor backing, sponsorship or recommendation from IASIST.

The unauthorised use of any information contained in the Website, its resale in addition to affecting IASIST's intellectual or industrial property rights will lead to the legally established liabilities.

Privacy

IASIST is highly sensitive to information privacy issues. We respect your right to privacy and we believe that it is important for you to know how we handle the information you provide us with and we receive via internet. In general terms, you can visit the Website without needing to reveal any personal information. However, some of the contents which can be accessed from the Website might require the user to provide personal information.

By means of these General Conditions and in accordance with what is established in Organic Law 15/1999 on Data Protection and Law 34/2002 on Information Society and Electronic Trade Services (LSSI), after the modification introduced by the General Law of Telecommunications 32/2003, IASIST would like to inform its users about its data protection policy, so that they can determine freely and voluntarily whether they wish to provide personal data which might be required from them when they subscribe, register or participate in some of the services offered on the Website.

In this way, without affecting what is given above in each of the forms or registers on the Website, by providing their personal data the user is expressly authorising that this data can be included in a file owned by IASIST, for the purposes of the service on offer, as well as to send sales information for similar services or contents related with services or contents which have been requested.

IASIST is also committed to complying with their duty to secrecy with regards to personal data which they have been provided with as well as keeping this information confidential. IASIST will make the greatest possible effort to protect your personal data from unauthorised access over the Internet. However, the user must be aware that any data processed through this Website can appear on the Internet without guarantees of security, and this data might be seen or used by unauthorised third parties.

The user can, at any time, revoke the consent they gave to receive commercial electronic communications by sending an email to the following address: iasist@iasist.com.

The user's authorisation for their data to be processed by IASIST can always be revoked, without retroactive effects. Therefore users can exercise their rights to access, rectify, cancel and oppose by sending a request by email to iasist@iasist.com including the following data: (i) name, surname and copy of the interested party's official identification document and, when appropriate, the accreditation document for their representation; (ii) the justified request which specifies this application; (iii) address for notification and (iv) date and requesting party's signature.

The user should also communicate any change in the personal data which has been provided to IASIST as quickly as possible, following the procedure which was set up previously for this purpose by IASIST and which is given in detail in the previous paragraph.

IASIST reserves the right to use cookies at any time, without prior warning. Cookies are small data files which are generated in the user's computer and which can provide IASIST with different possibilities:

  1. Run a check on users: when a user enters their user name and password, a cookie is stored so that this information does not have to be entered for each page in the server. However, a cookie identifies the combination of computer and browser and not the person using them.
  2. Offer personalisation options: design (colours, backgrounds, etc.) or contents for the visitor.

The user has the option of preventing cookies from being generated by selecting the corresponding option in their browser.

In a similar way, IASIST reserves the right to keep information on the IP (Internet Protocol) address for security reasons and to evaluate how to use the Website. We do not use IP addresses to identify individual people.

Applicable Law and Regulations.

These general conditions are governed by Spanish law. For any type of controversy which could be derived from interpreting and applying the General Conditions, IASIST and the user, expressly renouncing their own regulations, are submitted to the Barcelona Law Courts, except in cases which are imperatively established by law to the contrary.
